Terms of Service
These terms cover your use of Cleanroom Control: the controller software, the online app, and the desktop and phone apps, provided by Coll Business Solutions LLC ("we" or "us"). By creating an account, accepting an invitation, or pairing a controller, you agree to these terms on behalf of yourself and the company you use the service for ("your company").
What the service is
Cleanroom Control monitors and controls cleanroom equipment. A controller in the room connects to fan filter units and sensors. The app lets authorized users see readings, keep history, set alarm limits, get alarm emails and escalate alarms nobody acknowledges, change fan speeds and schedules, run automatic pressure control, track maintenance and calibration, keep an activity log and records, and update controller software. The controller can also keep readings and a backup of its setup on an optional memory card.
Accounts and responsibilities
- Your company is responsible for who it invites and what role each user has. Anyone with operator, admin or owner rights can change how your rooms run, from anywhere.
- Keep sign-in details private, including your authenticator app and two-factor backup codes, and tell us right away if you think an account has been misused. We recommend two-factor sign-in, and your company's owner can require it for everyone. Your company is responsible for what is done under its accounts.
- Your company is responsible for the accuracy of the settings it enters, including the units readings are shown in, alarm limits, pressure targets, schedules, the people who receive alarms, and certification records.
Not a safety system or a substitute for your quality system
Cleanroom Control is a monitoring and control tool. It helps you run a cleanroom, but you remain responsible for your process, your product and your compliance. In particular:
- It is not a life-safety system or fire alarm, and must not be relied on to protect people from harm.
- Alarm emails, escalations and phone notifications depend on internet access, email delivery and devices outside our control. They can be delayed or missed. Keep the local alarms, procedures and backups your operation needs.
- Maintenance and calibration reminders are an aid. Your company remains responsible for its maintenance and calibration program and for the accuracy of the records it enters.
- Readings are only as accurate as the sensors and their calibration. The low-cost particle sensors that can be used with the controller are for trends and alarms only. They are not calibrated to ISO 21501-4 and can't be used for ISO 14644 certification.
- Cleanroom Control does not by itself make your facility or records compliant with ISO 14644, GMP, FDA rules such as 21 CFR Part 11, or any other standard. Your company is responsible for validating it for its intended use, if that's required.
Controllers, equipment and installers
Controllers and connected equipment are usually supplied and installed by a cleanroom company or installer. Warranty, repair and on-site service for hardware are between your company and whoever supplied it. Connecting equipment we haven't tested, or wiring it incorrectly, may damage it or stop it from working.
Support providers
If your company adds a support provider, such as the company that installed your cleanroom, that provider can see whether each of your rooms is running, down or has an error. When someone at your company clicks Request help, the provider can see and change your rooms for 24 hours, or until an admin ends their access. Your company chooses whether to add a provider and when to ask for help. Each provider is responsible for what its staff do while they have access. A provider may show its name, phone number and logo on the emails, reports and wall screens of the companies it supports, and is responsible for that information being accurate and for having the right to use the logo.
Software updates
We release new controller and app software from time to time. An admin chooses when to update a controller from the app, or someone at the controller taps Check for updates on its wall screen. During an update the controller restarts for about a minute while the fans keep running. If the new software fails to start, the controller goes back to its previous version.
Acceptable use
You agree not to:
- Try to reach another company's rooms, data or accounts.
- Interfere with, overload or try to break the service, the controllers or the network they use.
- Copy, reverse-engineer, resell or rent the software without our written permission.
- Use the service for anything illegal, or upload a logo you don't have the right to use.
Price and payment
Cleanroom Control is sold for a one-time purchase price, set out in your order or quote from us or your installer. There is no monthly or subscription fee to use the app with the controllers you've bought. Hardware, installation, on-site service and custom work may be quoted separately. Except as stated in your order or required by law, purchase prices aren't refundable.
Your data
Your company owns the data it puts into Cleanroom Control and the readings its rooms record. You give us permission to store and process that data only to provide and support the service. Our Privacy Policy explains how we handle it.
If a controller has a memory card, the readings and the settings backup on that card stay with the controller in your facility. Your company is responsible for keeping the card safe and for removing or erasing it before a controller leaves your control.
Availability and changes
We aim to keep the service running and reliable, but we can't promise it will be uninterrupted or free of errors. The wall screen keeps running the room and checking alarm limits when the internet is down. We may change, add or remove features, and we'll give notice of changes that significantly affect how you use the service. If we ever stop providing the online service, we'll give reasonable advance notice and a chance to download your data. The controller and its wall screen keep running your room without it.
Disclaimer of warranties
To the fullest extent the law allows, the service is provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent the law allows, Coll Business Solutions LLC is not liable for indirect, incidental, special or consequential damages. This includes lost product, batches, production time, revenue or data, even if we were told they were possible. Our total liability for any claim relating to the service is limited to the purchase price your company paid us for the controllers and service the claim relates to.
Ending service
Your company can stop using the service at any time, and can ask us to close its account by emailing us. We may suspend or end access for accounts that break these terms, don't pay fees they owe, or put the service or other companies at risk. When an account is closed, your company can ask for a copy of its data within 30 days.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute relating to these terms or the service will be handled in the state or federal courts located in Colorado, and both sides agree to those courts' jurisdiction.
Changes to these terms
If these terms change, we'll post the new version here with a new date. For important changes, we'll also let account owners know by email. Using the service after a change means you accept the new terms.
